Terms of sale are intended to provide legal clarity between buyer and seller.
As we would like you to be very satisfied with your order, we will do a lot to make that happen.
Even if you may not have a legal right to do so !

1. Terms and conditions of sale in brief
1. We do not accept any liability for:

-- ordering, buying, using and consuming our products.
You therefore do so at your own risk.
2. All Mescaline Cacti and articles are offered without obligation.
This means that we are under no obligation to deliver any items to you.
3. All our Mescaline Cacti are grown in the Netherlands.
4. All prices are inclusive of VAT.
5. The customer has to pay the shipping costs.
6. The entire content of this website is subject to copyright.

2. Legal Liability
You accept full liability for visiting our website
and for ordering, buying, using and consuming our products.
We do not accept any liability for the :
2.1 use and handling of our Cacti.
Be sure to handle Mescaline Cacti in a safe manner.
Place a long-spined Mescaline Cactus horizontally on a firm and low surface.
Beware of thorns, keep a thorned long Mescaline Cactus low, and away from your face, or the face of others.
Long Mescaline Cacti can tumble out of a pot !
Hold a long Cactus by the pot, and also in the middle of the stem with e.g. a cloth or newspaper.
2.2 consuming our Cacti.
Make sure you inform yourself sufficiently in advance.
Make sure you use a low dose the first few times.
Make sure you have a reliable and sober person as your helper, who is familiar with Mescaline Cacti.
All our Mescaline Cacti are grown virtually without (biological) pesticides.
We only use artificial fertiliser as cactus feed, so the fertiliser does not contain any animal fertiliser.
(Biological) pesticides are practically not used, and are broken down after only a few days.

2.3 Use and consumption of all other articles offered (= not Cacti).
All other articles offered are not intended for consumption.
The other articles offered are intended for the application described.
Please inform yourself sufficiently in advance about the operation, properties and effect of a particular article.

3. Free offer
All Mescaline Cacti and other items are offered without obligation.
This means that you have no legal right that we always deliver every Mescaline Cactus or every article to you.
Mescaline Cacti are natural products that are sensitive to influences of weather and nature.
The books on offer are limited in stock.
We do, of course, do our best to serve you as best we can !

4. Stock
Most of the books are in limited stock.
You cannot derive any guarantee from the stock listed on the website.

5. Legal status
5.1 Legal status in the Netherlands
All our products are legal in the Netherlands.
5.2 Legal status outside the Netherlands
We try to only ship our products to countries where our products are legal.
The legislation in each country differs and sometimes changes.
It is practically impossible for us to find out for each country.
5.3 Own liability (orders outside the Netherlands)
When ordering our products, you are responsible for all consequences regarding the legal status in your own country.
Please inform yourself in advance :
1. whether our products are legal in your country (laws).
2. about import regulations in your country (customs).
3. with a specialist in both fields.
5.4 Order only legal articles (orders outside the Netherlands)
When ordering, you declare that the Mescaline Cacti and other items ordered are legal in your country.
5.5 Do not order and use illegally (orders outside the Netherlands)
We do not want to encourage you to order and use our products illegally.

6. Cultivation info
All our Mescaline Cacti are grown in the Netherlands, virtually without the use of (biological) pesticides.
The low winter temperatures and high summer temperatures are very conducive to diseases and pests.

7. Website
7.1 Legal status of the Website
This website may not be used in countries where it is not legal to do so.
This website may not be used by persons in countries where it is not legal.
7.2 Content of the Website
The content of the Website has been created with the utmost care.
We do not guarantee that all information provided is correct.
Therefore, you cannot derive any rights from the information provided.
7.3 Age of visitors to the Website
The use of this website is restricted to persons aged 18 or over.

8. Prices
8.1 All stated prices of the items are:
-- inclusive of VAT.
-- per item, unless otherwise stated.
-- exclusive of shipping and insurance costs.
8.2 Peyote-Paradise has the right to change prices at any time.
Orders will be calculated and delivered at the prevailing prices at the time of ordering.

9. Shipping costs
Shipping costs are to be paid by the customer.
We ship with DPD, and sometimes with PostNL.
Shipping costs are calculated for the specified delivery address.

10. Payment
The total amount should be transferred to our giro account in the Netherlands.
You will receive an e-mail when we have received your payment, together with the invoice.

11. Retention of title
The delivered items (including plants) remain our property until the full invoice amount has been paid to us .

12. Ordering
12.1 The buyer is responsible for providing correct name and address details when placing an order.
Peyote-Paradise is not responsible for:
-- incorrectly entered name and address details by the buyer.
-- the consequences thereof.
12.2 Upon receipt of your payment, you will be sent the official invoice by e-mail.
The buyer must check that the name and address details on the sent invoice are correct.
The buyer must report any incorrect name and address details on the invoice in good time by e-mail.
12.2 You can change an order already made as long as we have read your e-mail with your changes.

13. Purchase agreement
13.1 A legal purchase agreement has not been concluded until the amount due for your order has been credited to our account.
13.2 The buyer may cancel this legal purchase agreement at any time thereafter.

14 Shipping
14.1 Your order is dispatched all year round.
Also during cold periods, as our Cacti are used to low winter temperatures.
Peyote-Paradise is responsible for shipping.
So if necessary, we wait a few days before sending until the temperature is slightly higher (> - 5 degrees Celsius !).
14.2 After receiving your payment, we try to send your order within 3 working days.
In practice, your order will be sent to you within 1 - 3 working days after the day of payment.
14.3 The buyer can choose a delivery address other than the address on the invoice.
14.4 You will receive an e-mail as a warning when we have delivered your order to PostNL.

15. Legal cooling-off period of 14 days
15.1 After you have received your complete order, you have a 14-day cooling-off period.
Starting the day after the day of receipt.
During these 14 days, the buyer may view the items, but not use them.
During these 14 days, you may rescind all or part of the purchase agreement of your order.

16. Cancellation of the purchase agreement
16.1 Within these 14 days the buyer may cancel the purchase agreement.
This without giving reasons.
16.2 Please contact us first by e-mail !
Perhaps we can mutually find a better solution to your dissatisfaction.
16.3 Please notify us by e-mail of the dissolution of all or part of your order.

17. Returning your order
17.1 Please contact us in advance by e-mail !
It is important for us to know when Mescaline Cacti are returned.
So that they do not remain in our mailbox for too long !
17.2 Shipping costs for returning the order are to be borne by the buyer.
This is according to the law ‘Distance selling’.
17.3 The buyer bears the risk that the goods bought and returned by him:
-- are received by us in good condition!
-- are in the same condition as when received by the buyer of the order.
17.4 Damaged returned goods must be reimbursed by the customer.
This is according to the law ‘Distance selling’.
If the damage was caused by the carrier, the customer can recover the damage from the carrier.
17.5 Make sure that the returned items:
-- are well packed.
-- preferably sent back registered and insured,
so that you have legal proof of the return and of our receipt.

18. Refund of the purchase price including shipping costs
18.1 Peyote Paradise will pay you within 14 days from the day after the day of your cancellation:
1. the total amount paid for the returned goods.
Provided that these goods are in the same condition as when you received them.
2. all other charges paid at the time of purchase such as shipping and insurance costs.
18.2 We will wait to refund until we have received the returned goods and checked them for damage.
This is according to the law ‘Distance selling’.
18.3 If you do not return all purchased goods, we do not have to refund the delivery costs.
This is according to the Distance Selling Act.
But we may do so, in proportion to the value of the returned items.
